1. Agreement and eligibility
By accessing or using The Signal Scan website, assessment, crawler, results, or report features (collectively, the “Service”), you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by Chaz Stead (“I,” “me,” or “my”). You must be at least 18 years old and able to enter a binding agreement, or use the Service on behalf of an organization that has authorized you to do so. If you use it for an organization, “you” includes that organization.
3. Assessment scope and limitations
The Signal Scan provides a directional marketing-clarity assessment based on your answers and the limited public website content available when the scan runs. Scores, evidence, findings, and recommendations may be incomplete, unavailable, or affected by site structure, robots rules, temporary errors, page changes, or automated analysis.
The Service is not a complete marketing, SEO, accessibility, security, legal, financial, performance, or conversion audit. It does not guarantee traffic, revenue, ranking, conversion, customer response, or any other result. You remain responsible for verifying evidence and exercising professional judgment before acting on a report.
4. Results, report requests, and links
A scan is associated with a unique results address. The address is not intentionally listed in a public directory, but it is not password-protected. Anyone with the link may be able to view the scan. You are responsible for deciding who receives it and must not treat it as a secure repository for confidential information.
The immediate result is available without an email address. If you choose to request the complete report, you must provide accurate contact information. The separate marketing checkbox is optional; requesting a report does not itself enroll you in marketing. Marketing messages may be stopped through the unsubscribe method provided or by contacting me.
5. Acceptable use
You may not use or attempt to use the Service to:
- violate law, another person’s rights, or website access restrictions;
- scan a website without the authorization described above;
- access private networks, credentials, accounts, or non-public information;
- introduce malware or probe, test, bypass, or defeat security controls;
- overload, disrupt, scrape, reverse engineer, or automate the Service beyond its intended interface;
- misrepresent your identity, authority, or connection to a business;
- collect personal information about visitors or website owners; or
- use results to harass, deceive, defame, or make unlawful decisions about another person.
Access may be limited, suspended, or blocked when reasonably necessary to protect the Service, third-party websites, users, or legal rights.
6. Ownership and limited license
You and the relevant website owner retain rights in information and public website content submitted to or retrieved by the Service. You grant me a limited license to retrieve, copy, process, analyze, store, and display that content only as reasonably necessary to operate, secure, and improve the requested scan and report.
I and my licensors retain rights in the Service, its design, software, scoring system, reports, branding, and original materials. You may use your result internally for legitimate business and marketing-planning purposes. You may not sell, sublicense, republish as your own product, or remove ownership notices from the Service or reports.
Voluntary feedback may be used without restriction or payment, while you retain any rights that cannot legally be transferred.
7. Availability and disclaimers
The Service may change, experience delays, reject a website, fail to retrieve content, or be suspended or discontinued. Third-party sites and providers are outside my control and may be governed by their own terms and policies.
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without express or implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free or secure. Nothing here limits a warranty or consumer right that applicable law does not allow to be excluded.
8. Limitation of liability
To the fullest extent permitted by law, Chaz Stead and contributors to the Service will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, goodwill, or business interruption arising from the Service or a decision based on a result.
To the fullest extent permitted by law, total liability for all claims relating to the free Service will not exceed US $100. Some jurisdictions do not allow certain exclusions or limits, so part of this section may not apply to you. These terms do not limit liability that cannot legally be limited.
9. Changes, disputes, and contact
These terms may be updated as the Service or law changes. The current version will be posted here with a revised date. Continuing to use the Service after updated terms take effect means you accept them.
Applicable law governs these terms without limiting mandatory rights available where you live. Before filing a formal claim, you agree to make a good-faith effort to resolve the issue by email. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
